obtaining german pass through german father

im 27 , my dad and mum got divorced 24 y ago,my dad married to german woman and got the pass few years ago, i am just wondering can i get the german passport through my dad as he is a german citizen now ?

welcome to the forum :!:

First I´d suggest to read >>this post<< in order to understand the difference between passport and nationality. What you probably want is German nationality, which will then allow you to get a passport.

You´d be German from birth through your father, had he been German at the time of your birth. Since he only became German after your birth, this is out the window.

Thus, to answer your question, we need more info:
  1. When did your father turn German, how old were you at the time?
  2. When he turned German, did you live with him?
  3. Where did he/you live when he turned German?
  4. Where does/do he/you live now?

thanks very much for your reply,

the answer to your questions are as follows

my father turned german 4 years ago , he is married to a german for more than 30 years but they have been living in iran before. the lady is my step mum and while he was married to this lady he had an affair with my mum and i was born, so by the time i was born (1983) my father and my step mum (german) were legally married together
2 , i was living with him in iran , i can prof that
3 , i was student in cyprus with student visa on my pass when he got the german pass, and then i came to uk with student visa on my iranian pass
4 i still live in uk with psw visa and he is living in germany with his german wife
i really wanna know what are my chances of getting german pass or any family visa for that matter , i dont wanna go back to iran and i havent got anybody there and i know i cant stay in uk much longer as my visa expires next year
please advice me on that or point me towards the right direction

Hi nader_neisha,

I´m not sure about your situation, but I´ll tell you what I know.

From what I gather your dad turned German while he was living together with his German wife in Iran in 2007. At that time you lived in Cyprus.

I have no idea how that qualifies him for German citizenship, but so be it, he turned German there and then.

The German nationalitylaw ("Staatsangehörigkeitsrecht") is this:

§10 Section 2 sais: wrote:(2) Der Ehegatte und die minderjährigen Kinder des Ausländers können nach Maßgabe des Absatzes 1 mit eingebürgert werden, auch wenn sie sich noch nicht seit acht Jahren rechtmäßig im Inland aufhalten.

My translation:
The spouse and underage children of a foreigner CAN (...) also be naturalised.
Problem is: In 2007 you were 23 years old, so you weren´t underage. Furthermore you didn´t live with him, so I guess you couldn´t have been naturalised at that time anyway.

So from what I see you can´t claim a German passport through your father. (Maybe someone else in the forum knows more?)

Next possible option: Adoption. However this only gives you German nationality if the adoption was applied for before you turned 18.

Since the adoption has not been applied for so far, it wouldn´t even matter if it´s applied for now... It won´t give you German nationality.

From what I see you can´t get German nationality at present.

Only ways out that I see: You can probably live with your father in Germany, or move to any place in the EU where he lives.

Other than that, I wouldn´t know.

I would strongly advise not to use fake documents. For naturalisatoin they´ll most likely be verified with the issuer, which would reveal the fake, and this would definetely be a (-) in your future immigration/criminal history.
