Hya

I need an urgent help regarding my tier 4 extension refusal. I applied in time but they made the application invalid due some problems with my pictures. Then applied again with no fees attached thinking that they deducted my fees. Invalid again due to no fees paid . My visa was expired when i recieved the application. So i ve sent the new application with new pictures and a cover letter as well. After 3 months got a refusal saying that i did not have enough funds in my account and it should be 5400 pounds. Plus they also mentioned i didnt showed them the progress of previous study.

Heres the full history :
Last course was finished on 27 jan 2011.
Visa was expiring on 27th march 2011.
Applied with new course admission CAS attached on 14th feb 2011.
Application returned invalid due to pictures problem on 15th march 2011. Fees deducted at that time.
Applied again on 15th march 2011 wid new pictures but fees not attached thinking that its been deducted already.

Invalid application again due to no fees attached on 28th march 2011.

Applied again on 4th april 2011 with everything.

Refusal on the grounds that not enough maintance funds on 27th june 2011. It should be 5400 pounds i put 1200 pounds in my account.

Home office assuming that i didnt study for the last six months so the funds should be 5400 pounds.

No right of appeal given..

Wht should i do now...

Also my 10 years long stay completing on 20 sep 2011.

Plz help me out.!!!!!!

I know one thing that they will not consider my " Established Presence " status becuase i didnt pass the course and taken the new course in a new college.

In order to apply as a fresh applicant i ve put 5400 pounds in my account on 02 july 2011 so i have to wait for 28 days. i.e uptil 30th july 2011. The question is will they consider my application because my 28 days legal time period is over on 27 july 2011 ?????

Also in recent refusal they didnt returned my passport and informed me to contact my local removal centre until 11 july 2011...

Wht should i do???

How bad this thing is on 10 year long residance status which is completing on 20 sep 2011.??????

Plzzz help me out..

See also Established Presence. Perhaps you can ask for a reconsideration of the maintenance refusal because of DN (student - course ‘completed’ -  established presence ) Kenya [2010] UKUT 443 (IAC)?

i am in the same boat. the home office have taken my passport too because i initially filed an in time application that came back invalid. when i filed the second application, i was refused based on funds as the home office are telling me that my application was out of time, when i sent my application 21 days after they sent my details back to me. in my second applicaion i wrote a cover letter and based it on the case law forrester because i made a mistake and unintentionally did not tick one box but they ignored it and used the date of the current application instead of the previous as i requested.

they are basically saying that i did not have section 3C leave. t is weird as some unis advise their students that they need to get an application 28 days after the ukba letter. what is the point if you are out of status due to an invalid application.

i am going to seek legal advice tomorrow but i want to stop the process form being removed and harrassed by an enforcemnt officer. i was going to file for 10 yrs can you believe it august 2nd.

hiya i am no expert. i think it is important to determine if section 3C was relevant from your first application. thats what i am going to do. ask your legal rep.
