hi,I have a drink driving conviction in jan 2008 and was banned for 9 months and had a fine of around £250,I am on a student visa from feb 2002 and my 10 year Legal stay will be finishing in feb 2012,iam i eligible to apply for ILR in jan 2012 or do i need to wait until jan 2013 thats when my drink driving conviction becomes spent.Please advise?

If you have unspent conviction(s) then you will not qualify for settlement until the rehabilitation period is over (276B(iii)).

You must not have an "unspent conviction" on your record on the date you post your settlement application or the on the date UKBA receives your settlement application (if sent by courier).
