Hello dears. . my Tier 1 visa was refused due to
maintanence problem. i left uk and after pankina judgement i applied for a review. Today i got a letter from UKBA which states "

Dear Mr Collin

I refer to your representations of 15 May 2011. I would like to
apologise for the delay in responding to you.

Following the decision of the Court of Appeal in Secretary of State for
the Home Department v Pankina [2010] EWCA Civ 719 (known as the Pankina
judgment), we have reviewed the refusal of your application made in the
UK and can confirm that, pending mandatory checks, you qualify to be
granted leave under the judgment.

As you have left the UK and now wish to resume your stay in the UK, we
have put in place a process to facilitate your re-entry.

To reinstate your leave to remain you will need to apply, free of
charge, for a Single Entry Visa (normally used for facilitating entry of
migrants who have lost or had stolen their BRP). The Single Entry Visa
is only valid for a month and grants the holder a single entry to the UK
but does not confer any other conditions. You will also have to supply
biometrics so that mandatory checks can be made before you re-enter.

You will need to apply to a visa application centre

Entry BRP Visa. You can do this by completing a VAF9 visa application
form <>http://www.ukvisas.gov.uk/en/howtoapply/vafs/> or you can apply
online. Please note that in section 7 of the application form you will
need to state that you are applying under the Pankina judgment, and if
you apply online under Purpose of Application select 'Others', and under
Type of Application select 'Biometric Residence Permit'.

VAF9 application form are available on our website at www.ukvisas.gov.uk


Once you have entered the UK on the Single Entry Visa you will then need
to submit the following documents to the UK Border Agency within one
month:

* Your original and current passport & two new passport sized
photographs;

Please note that photographs must be in accordance with the guidance
contained on our website at www.ukba.homeoffice.gov.uk and not more than
one month old.

The above documents, along with your UK contact details, should be sent
at the earliest opportunity to the following address:

Any delay in sending these documents will prevent your passport being
endorsed with further leave to remain and you will not have any
permission to remain in the UK.

Your documents will be returned by First Class Recorded Delivery.
However, if you would prefer them to be returned by Special Delivery,
please supply a pre-paid Special Delivery envelope.

Now i got few important questions about Letter. First of all, what is meant by Mandatory Checks?

Second if mendatory checks means Fingerprints and Biometrics , then we all have already provide to UKBA while in uk.

Third and Most important question is " Will UKBA check educational documents, Criminal record right now or they have already checked it ? since this letter is from UKBA Sheffield. Doesnt it sound like they have alrady made all the neccessary checks including educational background, criminal record, transport deptt, pay and pension etc since they dispatch it from shiffield. Can anyone clear on mandatory checks please. Thank you all

The UKBA undertake mandatory checks on all applications against biometric and biographical databases in the UK. This includes but is not limited the police national computer.

yes you are right. but i recieve this letter from shiffield uk. The letter states that send your application along with passport and photo to uk embassy in your home country. i mean if my record was not clear then why would they send me such a letter? obviously they had check everything in uk shiffield and after that they have send me this letter. is it true?
