Dependent Visa for UK born baby - evidence of funds

Hello

I am on a Tier-2 visa (then called WorkPermit), issued for 5 years, and came to UK in Jan 2009. I have my visa valid until Jan 2014. At that time, my wife and daughter also came with me, and they also have a dependent visa stamped until Jan 2014.

We had another baby girl born in May 2011. I am trying to understand the maintenance fund requirements for this additional application.

- I want to apply now because we need to travel to India in the 2nd week of Dec
- But unfortunately, I had not foreseen this travel, and I do not have the minimum required amount of 533 GBP(?) in my bank account for the last 3 months.

1) Given that my wife and I already have leave to remain until Jan 2014, can my baby's dependent application be refused when I apply in-country?
2) Also, if I make the application from VFS Delhi, can the application be refused on the same grounds?

If the applicant does not fulfil the mandatory requirements, an immigration application will be refused - irrespective of the location.

Thanks a lot for your inputs. But I must say that rules cant be blindly applied.

If my wife & 1st child have leave to remain until 2014 and are already here in UK, why would the home office reject my application? where can I go and leave my kid?

Has anyone else been in a similar situation? Please share. I will be grateful for your inputs

Got the visa yesterday

We came to India a couple of weeks back and I applied in person at the VFS the very next day. I received the visa for our little girl yesterday. Key points to note

- Had to complete the form online and take a print out (new)
- The visa officer does not ask for specific documents but leaves it up to the applicant to submit all the documents that the applicant believes are relevant to the case
- I submitted the usual suspects but did not overkill - for example, i did not submit lease agreements, HMRC tax forms etc.
- At the time of application, my three month bank statements had quite a few days where the balance was less than 100 quid, and a few days where it had been overdrawn

I was very anxious, but received the visa promptly in 8 business days. Here are the learnings

- The visa officers are sensible and smart. They use common sense
- I have been in a steady, continuous white collar job with a known brand name and make more than 65K pounds. I had submitted 3 month payslips. So the officer could verify that the same amount got credited into my account on a monthly basis by cross checking the bank statements
- I also have M.S. from United states. Whilst I did not submit my educational certificates, I am sure it was easy for them to check my qualifications since i am already a visa and must be on the system
- Same reason, it is easy for them to check whether I am a genuine tax payer since I must be on the system

Bottom line: Bank balance is just one element of your application so don't get too stressed. If you are a legit applicant working full time with a decent salary, you should not be worried
