Hi All,

My question :-

1. What will be impact when Tier 2 Visa extension applied ?

2. What will be impact on PR application ?

PBS migrants have residency status. They are not tourists.

Although Tier 2 candidate are not tourist but the rules are written in such a way that , it looks like it is applicable to tier 2 as well.

It states very clearly :-

The Immigration Rules change will provide that where a person subject to
immigration control has failed to pay charges of £1,000 or more due to one or more relevant NHS body in respect of NHS treatment charges invoiced on or after 1 November 2011, the person should normally be refused permission to enter or remain in the country or have their leave cancelled. The UK Border Agency will be provided with sufficient data to identify the debtor, namely full name, address, nationality and
date of birth, Medical data will not be provided.

has failed to pay charges and charges invoiced referring exclusively to those people who were subject to charging (namely visitors) and were invoiced, yet did not pay. PBS migrants are not subject to charging and therefore would not be invoiced, and therefore the failure to pay would not arise. Subsequently, the refusal of leave on the basis of this failure would also not arise. Is that clear?

However Tier2 are under immigration control.

That's not relevant when taken individually and the statement is not limited to saying only this. It says immigration control and failed to pay charges that were invoiced. The two conditions are not independent. If the ad. in the lonely hearts column asks for someone who is tall and handsome you can't say that you qualify just because you are tall. You need to be both.
