Overstayer wanting to get married

hi
My partner's and I are planning on getting married. my question is l have no valid leave to be in the Uk and my passport was kept by the home office when my visa was refused, what do I do to register my marriage. I contacted my local register office and they said I need my passport to do so

You need to prove your identity to the registry office; they are not interested in your actual immigration status. That is why they are asking for your passport.

I rang the register office, and the emailed me the forms. The lady i spoke to told me that I need to have my passport or travel document from the home office. If I dot have this I need to contact the home office and they need to give me a letter. So very confused

Yes, that makes perfect sense. What she is saying is that if you can't provide your passport (to show your identity) because the UKBA won't release it, then ask the UKBA to provide a letter in lieu of this.

It didnt make sense to me because I explained to the lady that I have home office letters and my driving licence but she still insisted I need to contact the home office.
Nway thank you, will phone them again on Monday.
