Husband ILR based on 10yrs....when does wife qualify her ILR

Hi Guys,

Writing on behalf of a friend of mine.

He got his ILR based on 10 year rule. (student 7yrs + PSW 2yrs + Tier1 Gen 1Yrs). he has been married for 4.5 yrs and his wife always had a dependent visa. As he was applying on a 10yr rule he did not apply for his wife.

Now, is it the SET(M) form his wife should be using? when does his wife qualify for her own ILR? they both always lived at the same address throughout.

any help is greatly appreciated.

Just one last question.

is there a time period within which his wife needs to apply for her FLR(M)?
i remember to have read that his wife is to make an application within 28 days from the date of issue of his ILR, can you please confirm.

She should apply ASAP before her leave expires or before she travels. Note that English test is different from KOL.

Thanks Vinny, I think her graduate degree was taught in English which is equivalent to a graduation course here in the UK. But she might need a letter from her graduated university to confirm her medium of instruction.

one more doubt again, help is really appreciated.

say her FLR-M was successful this week, is she qualified to apply for her SET-M the following week? or that she need to spend 2 yrs on FLR-M before she can make her SET-M application?

1. 2 years on FLR(m) then ILR (If was not a dependent before).
2. If qualification was obtained overseas plus non-speaking English country then UK NARIC letter is required and not just a letter from the institution stating that the degree was taught in English.

it depends under which categry the main applicant had leave before applying for ILR, and on what category of leave the wife has, and for how long.

Main applicant is applying for 10 years ILR (6 years student + 4 years Tier 1)
and wife as dependant after marraige for 4 years.So If main applicat apply for ILR under 10 years then whether wife can apply for ILR once mail ILR is granted?

yes she did english language test for FLRM, though her degree was accpetable but i didnt want to take risk, and now she has done life in uk ,.

Please let me know for FLR M UK Naaric letter is enough or my wife has to write english language test?

Which is the ideal one? UK Naaric or English language test, also what are the documents required for FLR M As I will be applying for ten years and my wife will be applying for the first 2 years which is FLR M, any specific bank balance has to be maintained for the last 3 months? also what type of exam is required if she is taking her English exam. She had completed her bachelors in Computers back home.
