GOING THROUGH DIVORCE

I have been married for almost 5 years now. My wife has been in this country for just over a year now. Things are not working out between the two of us and i will be divorcing her soon. Is it possible i can have her deported after the divorce?

Absolutely not and I find the tone of your question to be quite disgraceful. Her leave to remain in the UK is a matter for the UKBA.

Deportation is for those who have been convicted of a criminal offence and are served with a deportation order. Those who haven't been convicted of a criminal offence may be 'removed' if they don't return voluntarily have have no further right to be in the UK.

It is not possible for you to have your wife either deported or removed. If you divorce then you should inform the UKBA. It is then up to them whether they choose to curtail her visa, and to tell her that she needs to return home.

She is from Pakistan on a spouse visa, so theres no chance i can send her back then?

Thankfully not. I wish her well and hope she seeks suitable advice from a Family lawyer in addition to advice on her immigration status.

no - you are not an immigration officer. It is up to the UKBA. Hard luck..

You should try living with a woman who just wants money and doesn't respect you or your parents and just sex all the time. No cooking or cleaning just watching porn on my laptop all day and night. Now tell me if I'm wrong?

Fine then divorce her. Doesn't mean you can 'have her deported'. It doesn't work like that.

It's me and my parents who have spent so much money bringing her into the country so why should she be allowed to stop here?

Because, contrary to what you appear to think, spending £600 on a visa for your wife to join you here does not mean that you own her and therefore can control where she chooses to live, or give you the power to act as immigration officer. I don't see any further point in this thread. You have been given the answer, just not the one you wanted.

All you can do is withdraw your "sponsorship" of her dependent visa

To revoke her leave to remain in UK is up to the HO

UKBA will contact you once you send a letter that you no longer wish to "sponsor" her as your dependent

the UKBA are unlikely to contact him, other than to acknowledge that his marriage has broken down. They will not give him any information about his wife's immigration status.

Greenie, MB243.....Have sound knowledge ...as i have been seeing their prev posts...as they are saying its not possible to deport....

so...just try to contact a professional Atorney or any so they can guide you...so it will be clear for you and peace of mind......I am really sorry for your painful days.

They did contact me, albeit after 3 long months whether I want to withdraw. They will not disclose what the immigration status of your dependent will be after they take a decision.

The point in informing UKBA about your divorce is that you are totally disassociating yourself from your spouse & your spouse will not be considered as your dependent even if his/her leave to remain as your dependent has not been revoked
