He was born in April 2009 and ILR has been granted in Jan 2012. My son has indian passport. He was with me from April 2009 - June 2009 in UK. Then he came to uk from Feb 2010 - June 2010. Since then he is in India with my Wife's parents. thanks

I dont want to apply for MN1 and British passport from India - simple because i think it will take too much time.
1. Will the settlement application be very weak in our case ?
2. Any one knows how long it will take ?
3. I will be the sponsor of the child ( becos i have ILR not my wife). But child lives with wife's parents. Does that disqualify me as a sponsor ?
thanks for your help

Hi
I am eligible for 5 years ILR in May.My daughter was born in UK and went to India with Indian passport and with out UK visa.
Now I have applied for visiting visa for my daughter instead of dependent visa coz Visitor is cheaper than dependent visa. I will apply British citizen ship for my daughter after i get my ILR.British citizenship will take up to 6 months from out side UK.
Hope this is correct.Any suggestions please

It should be okay if they grant her the visa and she is able to enter the UK. How did you show
41(ii)?

nsrisri - i applied to visitor visa for my wife and child while i was on Tier 1. It was for the same reason - visitor visa is cheaper. I was granted. But my wife was working in india at that time. So that may be the reason they were granted visa

hi
i want to apply for child settlement visa for my child.
As per immigration roles para 304-305 - It should be ok. He was born in UK so that seems to make things easier. I think in this case 'sole responsibility' is not to be proved. Can any of seniors/moderators please validate my understanding. It might take long time but I am hoping it will be shorter than applying for MN1 and british citizenship from India.
regards

Sole responsibility is not required if both parents will be/are together in the UK.

I think the form is on the link -
http://www.ukba.homeoffice.gov.uk/visas ... ying-visa/
UKBA will decide which para of immigration rules does the child satisfy and then take decision.
This is my understanding ! May be wrong. But I dont see any other form !

This seems to be the case where there is
more than
one rule
applicable.
I think that you should tell them which immigration rules you are applying under, because

Hi nsrisri,
I have seen in the posts by you that you had applied and got visit visa for your UK born baby. I am in a similar situation now and want to apply for visit visa for my uk born son from India, Please could you let me know the following details
1. Which visa center in India did you apply
2. Was it general visit or family visit visa.
3. what all documents did u submit
4. how soon did you get the visa
5.did the child has to be present during the application submission.
6.what should be mentioned in the cover letter/ sponsor ship letter
7. any other thing that you think that needs to be taken care of regarding documents, funds or while application form filling.
I would greatly appreciate yours as well as any other membes who got similar experiences, to help with my queries.
