Notice of pending appeal

HI,

I am working in UK from April 2011. applied dependent VISA for wife and son from Hyderabad,INDIA but got rejected. now got Notice of Appeal pending letter. Does any body know what it is..please do the reply ....

Time Lines:

Depedent VISA Applied:July 11th 2011
Rejected: JUly 29th 2011
Applied for Appeal: Aug 9th 2011
Got Acknowlegement: Sep 3rd 2011
Got Notice of Appeal Pending:Oct 7th 2011


Notice of Appeal Pending Leter:

To the Appellant

The tribunal has received your notice of appeal against the refusal of your application.We have notified the place to which you made your application and asked them to prepare the relavent documents for your appeal.This process is expected to take around 2 weeks.

The tribunal will write to you after 7 october 2011 with further details on how and when your appeal will proceed.

You do not need to take any action at this stage.If u have any questions regarding the progress of your appeal,all correspondence should be sent to the address at the top of this notice quoting your appeal no <Appeal No>

why was it rejected in the first instance, can you please share for the people to give good advise.

As the letter already states no action reqd, sit and relax.

There are two reasons for rejecting


I maintained 4000 pounds 1600*2+800 for myself.
1.They want to maintain 6000(1600*2+2800)
2.There is no proof for marriage subsiting other than marriage certificate.



one more thing, when we recieve Notice of Appeal Pending means they didn't change original decision ?

Today..I called VISA CC. they told "they haven't looked yet my application since Aug 9th 2011. they can look at any time". i decided to apply freshly..i inquired new application does harm current apeal process or vice versa.

Did the HM Courts & Tribunals Service confirm that one can make a fresh application while on has a notice of pending appeal? If yes, then I had better put in a fresh application rather than have a long wait.

Yes..you can make fresh application while appeal on pending. this is 100% right. even i didn't belive first time. i called 3 times cc. 3 persons told same thing. i am sending mail anyway so that i can have mail confirmation.

Kk, thanks a lot for your response. I have been so frustrated the past one month that my husband has been away. Don't think I will get over being miserable if we have to wait another 5-8months to get a result. The only thing is they get to have our money again. It's well. All the best mate!!!

I too have faced similar issue. I have applied Dependent Visa for my wife in december 2011 and got it rejected on the grounds that I have not submitted
1. Marriage Photograph
2. Evidence of my presence in India eg. my travel ticket and copy of immigration stamp on passport.

I have filed an appeal in Jan 2012 with HM Court and Tribunals Service . In 27 March 2012, I have received a letter that British High Commission has withdrawn their decision.

I have dropped mail to visqry.newdelhi@fco.gov.uk and infouk.northin@vfshelplline.com stating the current situation and asking them what should i do next. I haven't received any response from them.


Is there any one here who have faced similar situation and knows how to proceed further. Any help will be really appreciated.

Today received mail with one letter as attachment from British High Commission, stating that my wife need to submit her passport within 4 weeks of the dated letter for visa processing. And this letter has been dated as 20 March which means i have only one week left to go to embassy. Infact, I haven't received the physical copy of this letter as yet.
I am quite surprised that letter which is sent 3 weeks back haven't reached my home address.

Currently, My wife is in manila, I need to make lot of bookings to bring her back to India to visit embassy office. I have requested the embassy for another 2 week period but not sure they will be able to response in time.

On the top of that, there is no person on their office who can talk to me on phone, only way is to send mail and wait for their reply.

I must say experience with British Embassy is not good so far.
