Help Regarding ILR application.

Dear Members,

Can you please help in order to get few clarification Regarding ILR application?

Holing tier 1 visa and my wife holding tier 1 dependant visa which is valid until 2013 Dec,
I will be eligible to apply ILR in few months as per current rule. But my wife will not be eligible to apply ILR with me as she will not complete require 2 years at the time of my ILR.
We are expecting a baby prior to my ILR date.

1. What type of visa I can apply for my baby once baby born.
2. What type of visa I need to apply for my wife if I get ILR? Is her Tier 1 dependant visa going to be valid until 2013 Dec after my visa status change to Tier 1 to ILR? if so can she travel (in and out to UK) using existing Tier 1 Dependant visa until 2013 Dec.

1. If baby is not not travelling, then baby is not required to apply for leave to remain. Baby previously born in the UK will be entitled to register for British citizenship immediately after you're granted ILR.
2. If wife is not eligible to apply for ILR with you, then she should switch to FLR(M).

1. No.
2. Post the query in the forum relevant for it.
3. SET(M) is for settlement and your wife is not eligible for settlement yet.
4. If you wish to, you may include your child in your settlement application. Other than his birth certificate, there is no documentary evidence required for the child.


When did your wife enter UK? When is her leave due to expire? (exact dates please).

My wife entered UK on first week of June 2011 and her current tier 1 general dependant visa will expire on last week of Dec 2013.

Regarding extension for my wife what form i need to use

we are planning to travel out side uk with this christmas holiday.

Dear seniors,
This week we (I and my new born baby) got ILR through 5 years working category Tier 1 General route. My wife couldn’t apply the ILR with US as she didn’t complete the 2 years in UK.

June 2011 my wife joined with me in UK as Tier 1 dependant . Dec 2011 we extended Tier 1 visa which is valid until 2013. My wife current Tier 1 Dependant visa is valid until 2013 Dec

I hope my wife can apply ILR on June 2013. Do my wife need to apply FLR M now. As she having her current tier 1 dependant visa valid until dec 2013.
We are planning to travel with this Christmas holiday. Can my wife travel In and out country enter again with her current tier 1 dependant visa

1.With new rules being introduced recently, your wife may apply for settlement directly, without the need to switch to FLR(M), as and when she becomes eligible (June 2013).
2. No problem in travelling overseas on PBS dependant leave in the interim.
