Dear Members,
Iseek your expertise on my Tier1 Entrepreneur Visa application.
I am currently on PSW and wish to switch to Tier1 Entrepreneur Visa, I have previously completed BA HONS Marketing from UK and do have £50000 in UK Barclays account on my name.
I am currently registered as director of a Training and coaching company and Apart from running the business on daily basis, I am working as a Marketing Manager at the company (which is NQF level 4 Job).
Now the main activity of the business is coaching training which provide services like hypnosis, life coaching etc. but I will be working in Marketing does it conflict with UKBA guidance? because the guidance states:
You must show that you have been engaged in business activity, other than the work necessary to administer your business, in an occupation which appears on the list of occupations skilled to graduate level (also called National Qualifications Framework level 4 and above), as stated in the codes of practice for Tier 2 sponsors published by the UK Border Agency.
Because the main business activity of my company is to provide coaching but I am not a qualified coach. Although I am working as Marketing Manager which is level 4 Job.
I hope I make sense.
Also I need to know if I am working as Marketing Manager what JOB Roles I should be doing? Because Occupation codes of practice for Tier 2 Sponsors only provide some examples of Job Roles. My concern is that how does UKBA decide what job roles should be associated with a Marketing manager? Do they have any guidelines or references to describe a job position.
My main concern is how do you prove the business activity in graduate occupation(NQF level 4 or above) and advertisement requirement for initial entrepreneur application of PSW holders ? What documents you require?

If the business activity is hypnotism, then that is what you should be doing. Whether that qualifies as NQF 4 or above is another matter.
For example, if its a plumbing business, you should be fixing leaky pipes rather than calling yourself vice-present in charge of marketing, if you happen to place some business flyers on the counter of the local DIY shop.
From the guidance:
If the business is a taxi firm, the main occupation is driving a taxi and you will not score points even though you manage the business. Your main activity is providing a taxi service which is not skilled to graduate level.
Or maybe you could hypnotize the caseworker and may him think everything is okay? |

Hi Mate. Just wana know that i am running a security company which provides security guards to other business and i am director of the company. my job title is Director , Operation & Finance.
