Tier 1 Dependent - Visa approval letter from HO missing

Post by icon3001 » Tue Nov 20, 2012 12:59 pm

Hi All
I know that for my wife's ILR application she need the Tier 1 dependant approval letter which she received from Home Office.
It looks like she is missing that original letter which is received from Home Office when she applied for the first time from India.

I would like to know did she really miss it or Home Office did not send that letter and just stamped her passport with the Depenant visa please

Does it effect on her application for ILR please.

Thanks for your help

I knew from forum that the original visa documents are required which I guess includes the visa approval letters. Is that not correct?

It would be difficult to produce a document which never existed or was never produced/issued.
Please do not send me PM if I haven't sent you one yet.

You only know from the forum that other people presented those documents!! That does not make it a requirement!!!

Main Applicant (Myself) : Came to UK as Student in 2004

HSMP (In country VISA) : 01-Dec-07 To 30-Nov-09
Tier 1 18-Jan-10 18-Jan-13

Wife's Tier 1 General (Dependant) visa valid from: 09-Mar-10

She Came to uk on: 01-Jul-10 (after 112 days)
She went back to India after 1+ year in UK and lived in India for 8+ months (Total of 452 days outside UK).
She is now in UK living with me.

Tier 1 General (Dependant) visa valid to: 18-Jan-13

1. Am I correct that she can apply for ILR along with me in the same SET(O) Form as a dependant since the absent days does not count in dependant's case and she got Tier 1 (General) visa before 9 July 2010 and dont need to be physically living in UK with me for whole 2 years.
(She went for medical reasons)

Post by icon3001 » Tue Jan 01, 2013 2:49 am

My Appointment is on 3rd Jan, waiting from experts for my question please:

Her First Entry in UK (July 2011) to Today is 2 yrs 6 months

She lived with me physically for total of just less than 14 months
She is away from UK for just more than 14 months for medical reasons

Is she qualified to apply with me in SET(O)?

Wife Got ILR Dependant visa from India on 9 March 2010
After 112 days , she first came to UK on 1 July 2010
Lived with me in UK for 10 months
Went to India for 4 months (personal visit)
Back in UK for 2 months (she left UK for her health issue)
Went to India for 10 months (medical reasons and have proof of treatment)
Back in UK now and its been 2 months now living with me.

Overall: Lived with me physically for total of just less than 14 months
Away from UK for just more than 14 months

Total Period: Her First Entry in UK to Today is 2 yrs 6 months

Secondly: My Permanent Job Employer Letter (stating my job position, start date) is dated 12 Nov 2012. Should it be recent letter (dated within one month)? My PEO appointment is 3rd Jan 2012.
