hi our first tier tribunal was dated for 17th jan 2013........................... but ukba have withdrawn
there case should me and my wife be refunded £140.00 ..............................
......................if there was no case??????

eea2 refused in november......with right of appeal ......appeal date set for tribunal 17th january2013 .......the home office presenting officer withdrew case before court date??????

What reason did they give for withdrawing their decision?

If there was no material change to what you presented as part of your appeal then I would say it would be reasonable to request a refund as you have incurred an expense for no reason.

However, if you have supplied new evidence and UKBA withdraws on the basis of that and grants you what you are after, then I would say no because the amount payable is only a token amount towards the true administrative costs of an appeal.
