I need help with EEA4

Post by Makendlas » Mon Jul 08, 2013 2:55 pm

Me and me wife are not longer liven together and I need apply for EEA4, we are Legally married for just over 5 years, they ask on application for evidence of Relationship for the last five years and I don't have it, she told me that she won't help with this, she will only give her passport, if I need so, what should I do now?

EEA4 or EEA2

Post by Makendlas » Mon Jul 08, 2013 10:32 pm

I just finished the 5 years visa from the EEA2 application form, and I suppose to do the EEA4 but unfortunately I don't have all the evidence to prove that I been with my wife for 5 years, we broke up about nearly 3 years ago, but we never divorced, so if I can't apply for EEA4 can I apply a visa extension? And how do I do that? Please somebody give me some advise please.

Could you point out where this is required in the form?

You only need to prove 3 things:
1. Relationship - a marriage certificate is enough.
2. EEA national treaty rights for 5 years.
3. Your residence in the UK for 5 years (doesn't need to be the same place as your wife).

I did submit an application form (EEA4) on February 2013, me X did help me given me her passport, P60 payslips and letter from her employer, but she had to go abroad in May, so a send a request to the home office to send back only her passport, and instead they withdraw the all application they seeded a letter with the document saying that the application has been withdraw, they hasn't refuse the application, Do u think Can I still resend the application? And should write on application that we are separate but not divorced? I call to the home office 2 days ago, I asked about if I can resend the application and they told me that at this right moment I'm illegal and I should go back home, but I've got house over here, bills and thinks like that, now I'm very confuse I'm illegal or legal?

So what's the issue here? Just resend the application if you got all the documents.
Under EEA regulations, you are either married or not. There is no status of separated. If you are still married, you are still married. There is no need to explain your personal circumstances. Just provide proof you are still married.

As I asked you in my first post which you didn't answer -

If you are married, all that is needed is marriage certificate to prove relationship. Nothing else.

It doesn't matter that your 5 years RC has expired. Under EEA regulations residence documentation is not mandatory to have. You are still legal in the UK.

If only you apply, it's £55.
Section 4 is not relevant to your application as you are not divorced and your wife is not dead.
Section 8.1, 8.2 is for both you and your wife.
Section 3 is for your wife details.

Should I tell the home office that me and my wife are not longer liven together?
