Previous Employer not co-operating to sign/seal payslips

Post by kavi_krishna » Wed Jun 20, 2007 6:14 pm

Hi All,

For the Previous Earnings category, I am qualifying with 45 points which is the main scorer for me. But as I Have resigned from my company recently, the employer is not co-operating in signing or sealing the printed payslips.

Its just 2 months since I joined the new company, which won't be of help.

Any suggestions?

You have payslips, you don't need the signed
I am sure he provided you a p45? and P60
You just write as I resigned, employer is not being amenable in stamping the payslips but these payslips are authetic or something like that

You need signature & stamp only if your pay slip are acquired online and/or printed on plain paper. But if it is on the company paper, you do not have to. But if you could get this it is better.

FYI signed pay slip is not common in the UK. Stamp pay slip is even rather strange as in the UK even for importnat contract (Like your emplaoyment contract, contract with other companies, external letter) it is not common to stamp the letter. DOnot beleive that have a look on your employment contract, do they have stamp on it ?

I think the caseworkers know very well about this that is whay it is not writter in the guidelines the requirement to stamp or to sing your pay slip if it is not acquired online

Hi all,

I think I forgot to mention that the payslips are indeed the online ones. I have just taken the printouts, but it does contain the company logo very clearly.

I also have a online annual compensation letter. Will that help?

If you can't get the online statements signed, perhaps you could submit them nonetheless along with your employer's letter (the compensation letter you mention) as well as your bank statements. (I assume that you don't get have your tax return, or that it otherwise doesn't cover the period for which you're claiming income. If you submit all three items, excluding the tax return but with the payslips unsigned, I wonder whether that means you'd effectively be asking for exceptional consideration. If so, I'm not sure how convinced the caseworker would be by the claim of an intransigent employer.

I think better to refer to case worker internal guidance

"Wage slips should either be formal pay slips or on company letter headed paper. If they are on plain A4 paper then they should be clearly stamped and signed by the employer.

Any wage slips on plain paper, which have not been endorsed and stamped by the employer, should not be accepted.

Applicants who can only provide on-line payslips will be required to obtain their employers’ signature and stamp on a printout to authenticate the evidence."

I hate to say this. Because your on plain A4 paper on line, it seems you need to ask your employer to sign and stamp your pay slip. (Although your company logo is clear on it).

I think their request is sensible as anubody could easily cut & paste the company logo from internet. (please do not get me wrong that I am accusing you, but I just try to shed the light)

I know in the UK, how painful it is to ask your employer to sign 12 piece of pay slips and stamp it. One piece of paper from your employer which clearly state your salary month per month might work, probably. But do not take my word for granted, do it with your own risk.

Good luck with your applcation

might I also remind you that you can consider legal action on the company, for willfully hindering your efforts to get your HSMP. I'd guess that might be within the lines of violation of human rights, or something like that. Any legals in the crowd care to comment?

I'm not sure how you left things off (ie if you did things right on your end, like give them all the required notice before leaving, etc), or if you'd even want to say hey I'm talking to a lawyer, but I think they might become a little more cooperative for the sake of not having to deal with the hassle.

I submitted online payslips and they seemed to be accepted by the HO. However I also had a letter of offer detailing the annual salary as a supplement so I don't think this is application of the rule is consistent. In any case, of course provide the strongest case possible but you can only do what you can only do.
