advice needed as my wife has refused to help!

I am Africa and have been married to a british citizen since late 2011. i got a spouse dependency visa in 2012 febuary. we have since been living happily, until a couple of weeks when she just changed attitude wise.

It is now almost time (2 months) to apply for a settlement visa - SET (M), and she has refused to give me all documents i need from her ( travel passport etc) as well as refusing to sign the application form when the time comes.I really think she might not change her mind even when the time comes. she has also mentioned planning to file for divorce in january

SO IS THERE ANY OTHER MEANS OR IS THERE ANY OTHER VISA I CAN SWITCH TO/ APPLY FOR IF SHE DOES NOT CHANGE HER MIND???

As regards my employement status, I am a business owner that just started trading in November. I have made just over £2000 from two trades.

Your advise(s) will be appreciated

I will be very surprised if nothing happened as to instigate your spouse behaving in such a way.

If your spouse refuses to sign the form, you will be refused as the relationship will not be subsisting you also will not be able to extend under FLR(M). If you do not have children and have no other means to stay, you will face removal. You ought to work on making the relationship subsist, ask your spouse to allow an extension if s(he) is not willing to accept settlement. S(he) may be insecure and think you have been using her for settlement, perhaps you have done something to make her think this, that would need addressing.

A Tier 1 Entrepreneur Visa will be an alternative for you since you run your own company. Have a look at the requirements for Tier 1 Entrepreneur Visa application.

It might be easier to reconcile with your wife than going through the Tier 1 Entrepreneur route.
