Switching to ILR dependant from Tier 2 visa

Post by amarbrar1 » Sat Jan 04, 2014 5:45 pm

Hi

I am currently on Tier 2 visa and my Wife is on Tier 1 visa and she will be applying for ILR in coming November.
My question is can I apply for dependant ILR by switching from my Tier 2 visa within UK after she got her ILR or first I have to switch to Tier 1 visa and then apply for ILR? I am bit reluctant to switch to Tier 1 because I just joined in new company and don't want to go back to India and apply for Tier 1 dependant visa.

Can someone please tell me best way around to get dependant ILR visa.

Regards
A

You may switch to PBS Dependant while your spouse is under PBS.
You may switch to FLR(M) while your spouse is under ILR or is applying for ILR.

Note that switching (or applying for entry clearance outside the UK) will reset your qualifying period for ILR under dependant status for a further 5 years.
