Hi Amber, my case is also similar and need your expert advise please could you suggest..

my wife visa was issued in 25 June 2012 and she entered in UK on 23 Aug 2012..

I need to know which Form we should choose for her as she is dependent on main applicant and we need to apply together as her visa expiry is on same date as mine, is that Form FLR(M) or her details to be included in SET(O) form itself or Tier 1 dependent form? also they are asking too much information in case of FLR(M) form as she is dependent so not sure if all of them are applicable for her?

Secondly, as her visa is expiring on same date as main applicant, do we need two different appointments if going for PEO service? or we should be fine with only one apportionment for both of us?

I have seen an old thread on board which says -

When to apply for FLR(M)?

1. If dependant's leave is due to expire at the same time as the main migrant or within a short time after main migrant applies for settlement - Apply for FLR(M) at the same time as the main migrant applies for settlement.

2. If dependant's leave is due to expire before main migrant expects to receive a decision on his/her settlement application - You may wish to wait until reference number of the settlement application is received, so that the same can be referred to in the FLR(M) application.

When are you applying for ILR, is this as a PBS applicant (i.e. 5 years) and when does your spouse's leave expire?

Hi Amber, thanks for reply I will follow one thread only.

I will be applying early April as my current leave is till 24th April, also I first entered in UK after 60 days so u can take 90 days concession.
Pls see details below:
Visa stamped - 09-03-2009
First entry in UK- 09-05-2009
Current tier1 leave to remain valid 24th April 2014

Wife dependent
Visa stamped tier 1 dependent - 23-06-2013
First entry in UK- 23-06-2012
Valid till 24th April 2014

Your spouse can extend as a PBS dep before current leave expires then apply for SET(O) from 23-08-2014.

Thanks Amber, just one more question - so I can apply for my ILR first and then apply for her PBS dependent as her dependent visa will also expire same as mine, is that fine? and I think we need two different appointments for both the applications?

That's fine. I would do your spouse's application by post to save some money, unless there is an urgent need to travel. You never know, you may be able to vary to SET(O) if she becomes eligible before an extension decision is made.
