Tier 2(general) to FLR(M)

Post by vicd » Thu Jan 16, 2014 4:52 pm

Hi,

I'm currently under tier 2 general and my visa is about to expire in oct 2014. As my wife is British, I would like to apply for further leave to remain in the uk.

1. Is switching to other visa category possible?

2. if yes, which form should I use , FLR(M) or FLR(O).

3. What sort of evidence do I need to provide to show I'm in a genuine relationship? Pictures etc are useful?

4. Even though my current visa expires in oct 2014, I would like to apply for the visa by the end of February. Is this ok or will UKBA say its too early for applying? (I really want to get out of my current job!)

Thank you very much for your help.

Vic

FLR(M). However, the route to settlement will be 5 years and will have a Financial and English Requirement. Requirements will have to be met 3 times in total. You can switch whenever you wish, providing you meet the requirements.

Thank you for the reply. But what do you mean by "meeting the requirements 3 times"?

You will need to meet the requirements when you switch to FLR(M) which will be valid for 2.5 years. When you extend for a further 2.5 years, you will need to meet the requirements again and when you apply for ILR on Set(M), meet them again.

How long have you been in the UK? Your route to ILR might be easier and cheaper if you remain on Tier 2 G.

I've been in uk for almost 9 yrs( in sept 2014). 4 yrs under student visa, 2 yrs under PSw and 3 yrs as tier 2 g. I guess I can apply for ILR next year when I get my spouse visa? I don't want to stay more in my current job. I want to move otherwise I would have gone for an extension.

Yes then if you switch to FLR(M) now then once you reach 10 years, apply for Set(LR) on long residency basis which is a postal application only.

Thanks for the useful advice again. Do you think I can apply for the spouse visa in end of feb even though my current tier 2 expires in oct 2014?
