Am I eligible to apply for Retain right of residence?

My question: (Please read the case scenario)

1, Am I eligible to apply for Retain right of residence now?

2, If yes, do I have to apply for retain right of residence now or at the end (October 2015) of my Eu family member residence permit?


Case scenario:
1) I’m Non-EU citizen & my Partner French Citizen

2) We entered civil Partnership on march 2010

3) Due to plenty of personal reason we gone to dissolution of our civil partnership

4) On September 2013 a conditional dissolution order made followed a final order on January 2014 (in civil partnership for 3 years 10 months till the date of final order)

5) We lived together around 2.5 years in UK

6) Visa Status: Residence card of a family member of EEA national (October 2010 – October 2015)

7) My European partner was working & Self-employed for this whole period
1) I collected as much as document I could as one of uklgig solicitor advised. List of document below
o 2010- P60
o Jan 2011- P45
o Letter from inland revenue with tax break down from 2007-2011
o 2011 (the worked for French company under one year contract stayed in France for around 10months got French company contract letter & tax return for that year (2011) from France Government)
o 2012 -2013 he was self-employed and got the
 Tax return (2012-2013)
 Business Bank Statement
 National insurance contribution
 Company Registration certificate
 Invoice from different Suppliers & Customer
o 2014
 VAT Registration
 Business bank Statement
 Invoice from different Suppliers & Customer
 National insurance contribution

8 ) Living together Proof
 Council Tax bills (both name)
 Bank Statement (each got 2 bank statement)
 Mobile contract (Myself)
 My employment letter (myself)
 All Business activate are registered to home address
 Got other credit card bills

9) Myself non-EU citizen:
 I was working for all the years when we are in Civil Partnership got all employment records with me
