Hi All,
I would like to get some advice from experts here. I got married in April,2012 to a non-EU citizen when I was a permanent resident in UK so She got dependent on PR in UK for 27 months. In Feb,2013, I got British passport and then I got a job in Denmark (temporary contract for 6 months). We moved together to Denmark after she got Schengen visa for three months from Danish embassy as a dependent on EU citizen(me). After three months (in July,2013), we were told to apply for resident permit in Denmark on the basis of sufficient funds(in my account) as nobody can stay legally after three months here even if one has any EU passport. Having applied,I got a letter from Danish embassy and my wife got a resident card. The reason why we applied on the basis of self-sufficiency is that I have my own company in UK and I am paying tax in UK.
We went to UK in August,2013 and she had no problem whilst immigration process as she was having dependent on PR till July,2014. The next time, in Nov,2013, when we went to UK, but this time an immigration officer objected that she is staying outside UK for six months so she is "wasting" her visa. She also told us that it will be difficult for her to get visa next time in UK and also made a note on immigration form. She also got confused on having permanent resident of two countries(UK and Denmark)
Now I am confused why it would be difficult to renew her visa in July,2014. Since I am working from Denmark temporarily and we have to abide by the immigration laws of Denmark, we had to take resident permit of Denmark. Also we are paying tax in UK so it doesn't make any sense to me what she said. Can anyone please advise on:-
1. After finishing her "probationary" period of 27 months, will she get British passport?
2.If she doesn't get British passport, will she experience any difficulties extending her visa considering that we stayed UK for one year and rest of the time is spent in Denmark.
Thanks.
