Finland and implementation of directive 2004/38

Finland implemented the directive since 30 April 2007, but as Ireland (discussion on the Ireland forum), non eu/eea/swiss family members of eu/eea/swiss citizens only benefit from it if they've resided with the eu/eea/swiss citizen in a different member state before moving to finland - if not, they have to apply under finnish national law for entry into finland, if they resided in a 3rd country outside the EU, EEA and Switzerland.
From what i understand ,having read through the discussions on the Ireland forum and the directive itself, this is not in accordance with the directive.

Although the directive does not apply to Switzerland, the swiss adopts the same stance as Ireland and Finland, regarding residence in another member state for non eu/eea family members, before moving to switzerland, and staying in a member state as a tourist, short stay visits, are not taken into consideration. For those who understand french, here's the link:

Any other member states that requires residence in a different member state before moving there?

Have you asked the Citizens Signpost Service about this?

PS I've opened a thread about Directive 2004/38:

and linked to this thread.

It seems to me not one of the EEA states are iplementing the Directive in the spirit it was intended!

Ironically, the UK, which is usually one of the most reluctant EU legislation adopters, probably has one of the best implementations of Directive 2004/38.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Couldn't agree more. Read my thought and posted it loud. There are other countries like Spain etc who seem to have done a better job but you have to admit that the UK is in the top tier as far as the Directive is concerned.
