ILR Eligibility for dependant

I came to UK on 20-Nov-2010 as a tier dependant and move back to India on 10-Aug-2011. My husband changed his visa to ILR in the meantime, I came back to UK on 5-May-2012 using my old visa (Tier 1 dependant) and switched to ILR dependant visa using FLR (M) form on 5-May-2013 (I applied it by post before my old visa expires and they took 7 months to issue the visa so it looks like a 6 months gap in the visa) and the visa valid for 2.5 years as per the new rule. Home office letter (came along with the visa) mentioned that I need to wait for 5 year to apply for settlement so one more extension I need to make. I’m confused because others are telling I can apply now itself. Can you please tell when I’m eligible to apply and also what form I need to use SET(0) or SET(M)?

Reentered in UK: 5-May-2012 using Tier 1 (General) - Dependant visa
Visa Renewed: 5-May-2013 valid till: 5-Nov-2015
Category: Settlement – Dependant (FLR(M))

Can someone please guide me with the below queries?
1. When I am eligible to apply ILR?
2. Which form do I need to fill?

You were granted the wrong leave, you should have been granted FLR(M) under Part 8 of the immigration rules, write to the Home Office and dispute this explain you had transitional protection and your leave should have been granted under Part 8 for 2 years.

If you are granted FLR(M) under Part 8 then you may settle straight away, on SET(M) by virtue of 287(a)(i)(d), B1 English and LIUK required.
