ILR Dependent eligibility

Post by Vijay.pailla » Wed Nov 26, 2014 3:39 pm

Hello

This is Vijay

I have been granted citizenship last month

My question is regarding my wife's ILR application

We got married in NOV 2011 and she is in UK since DEC 2011

Is she eligible for her ILR now as it was 2yrs of stay as a dependent before the rule was changed in april2012

Please can anyone confirm me on this issue

Thanks
Vijay

she will be eligible for ILR, use set (M). Once granted, You can apply for naturalization as well assuming your wife can satisfy the below points

lived in the UK for at least the 3 years before your application is received
spent no more than 270 days outside the UK in those 3 years
spent no more than 90 days outside the UK in the last 12 months
not broken any immigration laws while in the UK

Thank you for the reply

But is it SET(O) or SET(M) as she is on PBS dependent status now and heard that PBS dependents can go for SET(O)

Can you please clarify

Thanks
Vijay

If she had never switched to FLR(M) and you were granted ILR under PBS, then she should use SET(O).
