Category to choose for wife - Visa4UK

Post by spring123 » Mon Dec 29, 2014 3:45 pm

Hi,

I am a British citizen (thanks to everyone who helped me earlier on this forum with my application!).

I am getting married in January, and my fiancée will be applying for a visa after our wedding, as my spouse. She's currently outside the UK / EEA. I'm trying to complete the online application at Visa4UK and I've hit a hurdle right away as I'm unsure about which category to choose.

Should I choose:

Reason for visit: Settlement or Other (options are: Visit, Study, Work, Settlement, Transit, Other, Exempt)

(I think it should be Settlement)

Visa Type: - Under Settlement, should it be Settlement (options are: Settlement, Returning Resident)
- Under Other, it has to be EEA / Swiss Family Member (options are: EEA / Swiss Family Member, Overseas Territory & Commonwealth, Others)

(I think it should be Settlement again)

Visa Sub Type: Under Settlement, should it be Wife or Marriage? I'm not sure why there are these two options?
Under Other, it has to be Family Member of an EEA national.

(I think it should be Wife)

I'd be grateful for guidance from anyone who has recently applied successfully.

Thanks so much

Sponsor details

Post by spring123 » Tue Jan 06, 2015 5:54 pm

Hi

Having completed the form further, I notice that there is a section called "Sponsor details" and in here, it asks for details of the sponsor. In my case, this is me, as a British citizen, sponsoring my fiancée, once we have married later this month. However, where it asks for "What is their relationship to you?" the drop down box does not give me an option to select wife or spouse. I'm now concerned that this may mean I've selected the wrong form. Has anyone else come across this issue?

Thanks in advance
Suresh

Some of the drop down doesn't give that. But is she really your spouse?she isn't until you're married and don't make mistake of submitting the form until after.

Thank you. I asked the Visa4UK team, and they responded as follows, for the benefit of anyone else reading this:

With regards to your query, Applicants only need to provide the sponsorship
declaration form if they are applying as a parent, grandparent or other
over 18 dependant relative of a British Citizen or someone who is present
and settled in the UK.
Applications for spouse, fiancé, civil partner, under 18 children, etc, do
not need to complete it.
Also in order to fill the application form at the visa4uk website , they
should chose ‘other relative’ and then explain in the free text box at
the end.

I have clarified that at the time of completing the online application form, my fiancée is still not my spouse, but that when we actually submit the form using the appointment booked through the system, at that time, she will be my spouse as we will only do that after our wedding date. I suppose that's ok?

Personally, if you are applying for a spouse visa once married, I think you should complete the application with those details. They won't know when the form was actually completed. What matters is that the information is true at the point of application.

Just FYI

The VFS application centre in Mumbai nonetheless asked for this sponsorship declaration form.
