ILR - time away from spouse/UK

Post by janakrb » Wed Sep 05, 2007 4:42 pm

Hello,

I entered UK on a spouse visa (Sep 22, 2005) and after staying in UK for 6 days, I went back to US (27th Sep, 2005) for a month to sell my car, wrap-up a few things and bring over my belongings that I couldn't bring on the first trip.

Would this month away from my wife be an issue when I apply for ILR? SET M form doesn't ask for any such disclosure. Is this a standard question asked by the PEO officers (I have a same day appointment at Croydon)?

The SET M instructions state that I should provide proof that I kept in touch with my wife for all periods of separation. We kept in touch over the phone on a daily basis but had used a calling card so unfortunately we don't have any records. For the application, I plan to include a letter from my wife stating that we were in touch daily, along with a few emails that I managed to find. Is there anything else that I can do to make sure the month away from UK doesn't become an issue?

Also, is the date of first entry on spouse visa always considered for the fulfillment of the 2 year requirement? Does the Home Office have any grounds to claim that given my first stay in UK on spouse visa was for only 6 days, I didn't start my settlement stay in UK until I entered UK the second time.

One month out of two years? No, it won't make a difference.

I agree, it'll cause no trouble.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
