Outside UK for 530 days- Will I get ILR and CITIZENSHIP?

Post by nallamilli » Thu Sep 13, 2007 9:58 pm

Hi! Guys
I am an Indian citizen, currently living in UK, I had come to UK on 9th March 1998. It will be 10years next march. By next march I will be eligible for ILR. I have spent about 530 days out of UK. At no time I was out of Uk for more than 90 days but I had exceeded more than 90 days in one year. I am wondering whether I am still eleigible for ILR on the basis of Long stay.
I am basically willing to go back to India but would be nice if I can come back to UK as and when I like to undertake shorterm jobs once in a while. I understand the best for this would be to get the UK citizenship and then go back to India. But I feel I may not be eligible for the Citizenship (one year after ILR) as I will have exceeded the maximum time spent outside UK of 450 days in the five year period.
Please advise I am totally confused.
Many Thanks
Ven

Hi - quite a lot more detail is needed:

On what basis have you been here since 1998? What visas? Have there been any periods in the 10 years (including periods outside the UK) when you did not have leave? Why were you absent?
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
