PLEASE HELP.....

i was wondering if anybody could give me some advice or info as i am having trouble finding it on the net...
a friend of mine is dating a brazilian man currently living in gran canaria (spain) the only thing is she asks him to come to enland to visit her, he says he cant and is has to stay in gran canaria for 2 years... not allowed out of country.
i think this sounds dodgy does this mean hes married? and does anyone know why he cant leave the country? any input would be greatly recieved

It may mean that he is illegal and cannot return there if he leaves.

thanks.. i think he is illegal, and the authorities found out and hes saying that its them keeping him there?? surely they would kick him out?

No.

Spain has an interesting policy on illegal immigrants that, quite frankly, is pissing off the rest of the EU.

In a nutshell (and there are exceptions), it summarizes as:

- if you arrive on Spanish soil (the Canaries count)

- Spain will ASK you to leave

- BUT :

If you manage to stay, generally there is minimal enforcement (criminal record lacking)

AND if you leave, re-entry becomes very difficult (or, rather, STAYING if you re-enter).

Therefore, he COULD leave the Canaries, but coming back would present very serious difficulties.

Spain has been allowing folks to travel from the Canaries to the mainland, but they are required to exit Spanish soil (thus becoming someone else's problem). France & Italy in particular are very unhappy with this policy.

This puts a person in the desperate position of entering the EU illegally, where the remainder of the EU nations are VASTLY more difficult to remain.

If he could even enter the UK (a serious challenge), then staying in the UK becomes a much more serious challenge. For most of us, we would describe it as a nightmare.


I'll grant him this: he is informed on the situation and he is not (entirely) stupid.

However, he is stuck in a very difficult siltation. His options to stay in the Canaries are limited and his options to leave are as dangerous as they are limited.

thanks for the help, good advice. yeah i kind of read up on the spanish immigration laws, very bizarre!!
like you said hes not daft.
hes telling her that he got caught driving over there without a license and the authorities took his documents inc his passport which is why he has to stay in the country etc etc.
personally i think hes married and hes having his cake and eating it!!!!

I would not be too adamant that marriage is the real reason. A person married to a Spaniard has to only stay for 1 year before applying for naturalisation. Now, how long it will take to come thorough is another story. But either way 2 years is not figure I would associate with marriage in Spain.

And since the nationality of the person in question is Brazilian, I do not think it is the concession given to the ex-colonies people who can naturalise after just 2 years on the WP.

Yeah, I agree with Docterror.

Just to add more info; citizens of Ibero-America (Spanish and Portugese speaking countries in the Americas), Equatorial Guinea, the Philippines and Portugal have the right of citizenship after 2 years of continuous residence in Spain and have the right to dual citizenship with that country and Spain.

This is most probably why he doesn't want to leave Spain, as the residence period must be continuous.
