I have found out that a non-EU spouse of a EU national on a tourist visa in that country is allowed to apply for the EEA Family permit to UK from that country, according to this UKVisas website, is it practically true?? (UK Embassy in Warsaw doesnt entertain telephone enquiries rather advices to call the visa agent which charges $14 a call for assistance)

Any one applied without the Karta Pobytu (Polish Temporary Residence Card) and got the EEA Family permit?21.4.1 - Handling and assessing applications for EEA family permits

For example, an Indian national married to a French national, who had obtained a visa to enter France as either the spouse of the French national or in some other category (as a visitor, student or work permit holder etc), would be considered 'lawfully resident' in France, if, at the time of application, they were abiding fully by the conditions of that visa.

And, does anyone knows if it works the same with any Schengen Visa; if any non-EU spouse of a EU National can apply for a Schengen Visa still on Tourist Visa in that country and before getting the temporary residence card?
