Hi everyone.
I really need to find some information
My friend story:
She came to UK in May 2000. From Crimea Ukraine. That time Crimea was Ukrainian territory.
In 2014 Russia take over the Crimea.
So in 2014 she applied for right to stay in UK because she cant back to Crimea. Because Crimea its not Ukraine anymore. Its 5 years long case. In November 2019 she won the court.
30.01.2020 she got her Leave to remain for 2.5 years.
In May 2020 it was 20 years Since she came to UK. Now her solicitor tell her that she can apply for ILR. But we know for ILR need 20 years+ 10 years legally.
She dont want to loose 4000pounds.
Please can you give advice is she elegible for ILR? She is 63 year old.
Thank you very much!

Do you know her full immigration history? This is needed to determine whether she can apply. Otherwise I suggest to help her apply for a detailed SAR:

Thank you very much for your answer.
She arrived to UK in May 2000.
Her visa expired in November 2000.
She never left UK.
2014 Appliction based on EU partner wich was refused.
2014 She submitted new application based on Humar rights.
2016 application was refused.
Feather submission was submitted.
Wich later was refused with the right to appeal.
2019 She have appel application in November 2019.
She was granted leave to remain based on the human rights claim as vulnerable adult. Her visa was given for 2.5 years ( 10 year route)
Now solicitor told her she can apply for ILR. We want to find if she really elegible for ILR or she need to wait for 10 years? Because with solicitors fees its will cost 4000 pound. Its will very expensive mistake.
Thank you so much.

You are correct. She is not eligible for ILR yet. She requires 10 years of legal residence in the UK before she can apply for ILR.
Ask the solicitor which Immigration Rule does he think would allow your friend to apply for ILR after 20 years illegal residence? I suspect that he would likely refer to
Private Life/Immigration Rule 276ADE . But as you can see, that only leads to ILR after 10 years, as you have correctly assessed.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

Avoid taking advice from this solicitor. He wants to take more money from her.

We will ask solicitor what immigration route she planning to use.
This solicitor won previous case based on human rights. May be she know other routes.
Thank you.
