ILR application (PBS dependant)

Post by London792 » Tue Jul 14, 2020 4:13 pm

Dear all, my wife's case is exactly the same as that described above. I just have a question about the documents. I only see the following in the "Documents" tab of the SET (O) application we are filling in for her:

Mandatory Documents
- Passport issued for the applicant (my wife)

Other Documents
1. NARIC letter (Why are they asking for this since we have clearly stated that her degree does not meet the English requirements and for this reason she took the Trinity College London English Exam??).

2. Declaration from me to give HO consent verification (this is clear and will provide this)

3. All previous passports (this is clear and will provide)

4. Current BRP (this is clear and will provide)

5. Evidence of the applicant's (my wife's) immigration status in the UK (Isn't this the same as the BRP??)

The above list is all the documents they need apparently. My questions regarding the above list are:
1. There is no mention of any co-habitation proof that I have seen discussed on this forum for the same kind of applicants as my wife, i.e. Tier 2 PBS Dependant going for ILR after husband got citizenship. Am I missing something?

2. Also, from the above list, there is no mention of any requirement to post bank statements either for me or for my wife. Is this normal?

Please could someone spare a few minutes to have a look and answer these questions. Thank you in advance!!

Please do not tag your questions onto other members topics.
1. NARIC letter (Why are they asking for this since we have clearly stated that her degree does not meet the English requirements and for this reason she took the Trinity College London English Exam??).
You should have ticked NO to the degree question. It is ONLY relevant to meeting the English requirement. HO doesn't care about her degree qualifications for any other reason.
5. Evidence of the applicant's (my wife's) immigration status in the UK (Isn't this the same as the BRP??)
BRP card yes. Some people don't have BRP cards and have 5 year visa vignettes.

Cohabitation evidence for the last two years is mandatory to prove subsisting relationship. The checklist is generic and just that, a checklist. You should be following the guidance notes and immigration rules and not rely only on a generic checklist.
2. Also, from the above list, there is no mention of any requirement to post bank statements either for me or for my wife. Is this normal?
Why would you need bank statements? There is no maintenance fund or income requirement.

Thank you so much CR001. And apologies for tagging my post to another member. I was merely trying to point out that my case is same as their's.

Thanks again
