Agency worker taken by company financial requirements

Hello my names David

I have a question about the financial requirements for a spouse visa for agency workers. Im a British citizen and i want to sponsor my wife. ive been working for 3 months through an agency meeting the requirements and more. But i have an offer to be taken on by the company. So the paychecks will have different company names eventhough im still working in the same place. Does anyone know if that will be an issue or if i should just stay with the agency for a few more months until i finish all 6.

Hi,

It shouldn’t be a problem. You’ll probably need to provide a letter from HR anyway to say you’ve been working there for 6 months at least so they can mention this on the letter that the initial three months were through and agency but you were will working for the company.

It is possible HO may deem it that they are different employers and that you do not meet the financial requirement under category A.

To give you an idea, you can check with the company (not the agency) what date they have down and will put on an employer letter as your start date with them.

For determining the category A/B, the key determinant is the length of service with a particular employer instead a particular location. Thence, it would be equivalent of change of employer prompting the category B into play.
