I am about to apply for ILR - Tier 2
I have 3 queries.
1) For the sake of simplicity, I worked from 1-1-2016 till 31-12-2016 in my first employment (1 year contract).
HR has issued me a letter mentioning my starting and last working Date + confirming no unauthorised leaves.
My second employment: 2 year contract
- 1st year in one city -> started from 1-1-2017 and finished on 31-12-2017.
- 2nd year in other city -> started from 1-1-2018 and finished on 31-12-2018.
HR from 1st year has issued me a letter mentioning my starting and last working Date + confirming no unauthorised leaves.
At the end of the year 2017, I emailed the HR in the other city where I was due to start from 1-1-2018, requesting annual leave in the first week of the year 2018. They agreed but forgot to update the rota and marked it as an absence initially. When I came back from outside country, I showed them all the email correspondence with them. They did not mark it as Unauthorised leave. They labelled it as compassionate - unpaid leave and put my starting date as 10-1-2018.
HR from 2nd year has issued me a letter mentioning my starting and last working MONTH only + confirming no unauthorised leaves. There are no dates in this letter.
Question 1 A: All my previous and current employers have put my exact starting date and last working date in the ILR reference letter + except for this 2nd year. The HR from 2nd year has Confirmed that I have not taken any unauthorised leave but did not mention my starting date or ending date (only mentioned Months).
Is it going to be an issue?
Question 1 B: If not, shall I just attach the letter they sent me (with no dates) or I should get a letter with starting and ending date instead of months?
Question 2: I get paid as PAYE ( I am on Tier 2). I have made some mistakes in filling tax refunds/self assessment tax returns. They have been corrected after I hired an accountant. Will it be an issue?
Question 3: Identity Theft Case: I received a fine collection letter from a company. When I rang them, they said that Court has issued this because of no show. When I contacted court, they told me that I travelled from Manchester to Liverpool via train and did not pay for the ticket. The railway line has been sending the fine letters and in the end, they contacted court. Due to no show, court fined 650 pounds.
When I saw the original court verdict and address of offender., it was being sent to some address in Liverpool and there was no name on the letter.
When I explained via email to the magistrate that I was working on that date (letter from HR), my picture so that they can match it with the pic of the offender from the trainline + I get highly paid and I am on tier 2 visa and would rather pay the fine than risk coming to the court, they asked me to do a virtual statuary declaration. After I did that, they said that we will restart the case but I should email all the evidence to the legal team of railway line.
When I did that, railway line team response was:
"Having assessed the email we will withdraw the case against you and withdraw the matter from Court. You are not required to do anything further and your file has been marked up as withdrawn."
Later on, as part of the confirmation/my personal records, I received this email from the court:
"On ------, at LIVERPOOL LIME STREET travelled on a railway, namely MANCHESTER VICTORIA TO LIVERPOOL LIME STREET, without having previously paid your fare of £15.00 and with intent to avoid payment thereof. Contrary to section 5(3)(a) of the Regulation of Railways Act 1889.
Dismissed (no evidence offered)."
Question 3: Do I need to declare this in my ILR application?
I shall be grateful for your help in this regard.
