apply 28 days before expiry OR 60 months? SET(M)

Post by Allan NC » Thu Mar 24, 2022 1:55 pm

I've seen conflicting information on when the earliest you can apply. Is it 28 days before current VISA expiry, or 28 days before 60 month period is up?

EG:
60 month period is complete on 9 June 2022
Current FLR(M) visa expires on 17 Aug 2022
When is the earliest application possible?

Thank you.

Set M is 28 days before completing 5 years from the day you entered the UK. Provided your initial visa wasn't a fiancé visa. If your initial was Leave to Enter SET M, then like I said entry date.

If issued here in the UK, then it's from the issue date.

Or anytime before the expiration of your current visa.

Many thanks for your reply.

This is the second FLR(M) visa.

So if I'm understanding correctly:
First VISA was issued on 09 June 2017
So we can apply for ILR on 13 May 2022. (within 28 days of 5 years since issue date)

Additionally, if we used the Super Priority Service we could get ILR decision within 24 hours, technically before the 5 year period is up.

Correct?
