The Effect of NHS Strike on Indefinite Leave to Remain and Extention of Limited Leave to Remain

Post by MyGodisable » Tue Oct 11, 2022 1:00 pm

Dear Colleagues and readers,

Please I will be in the process of extending my Limited Leave to Remain and after apply for Indefinite Leave to Remain. Currently working with an NHS hospital.

I just want to know what is the effect of going on NHS strike actions on the ILR application and Limited Leave to Remain extension since it is obvious that all the NHS staff want to go on strike with their respective professional bodies due to low pay.

I am really worried on this and will need members assistance on this.

Thank you all!

See the following links (not by the NHS) https://media.www.kent.ac.uk/se/10140/T ... action.pdf https://www.ucu.org.uk/heaction-migrantworkers

Is it worth contacting your workplace and asking them directly for further guidance?

It has no effect
SK8. Unpaid leave and salary reductions
This section tells you about your responsibilities if a sponsored worker takes unpaid leave or if you reduce their salary.

If the worker takes unpaid leave
SK8.1. Workers can take short periods of unpaid leave. However, you must
stop sponsoring a worker if they are absent without pay for more than 4
weeks in total according to their normal working pattern, during any
calendar year (1 January to 31 December), unless the absences are
due to any of the following:
• statutory maternity, paternity, parental, shared parental or adoption leave
• sick leave
• assisting with a national or international humanitarian or environmental crisis, with your agreement
• taking part in legally organised industrial action
