ILR for wife of (British Citizen from Tier 1 Entrepreneur)

Post by Ali Mama » Mon Oct 24, 2022 10:31 am

Hi, I became British citizen after spending 5 years on tier 1 entrepreneur. My wife has also spent 5 years in uk as my dependent. My question is,

1) what form we need to fill to for ILR application of my wife

2) Also, I have been receiving UC as during covid times, it was kind of impossible to survive without some support. Will this accept her application ?

Please reply.

Form SET(O) should be used. UC is often claimed jointly so it makes things a bit complicated but I have never heard someone being denied ILR because of UC

Universal Credit is a new benefit, brought in under the welfare reforms. UC is still being rolled out across the country for the exisiting claimants of any of the six welfare benefits that UC replaces.

Universal Credit has different rules and regulations to the some of the 6 welfare benefits it replaced. e.g. You still have to claim UC jointly as you haver a partner (it's benefit fraud if you claim as a single person when you are not) but now there is no extra benefit money for a NRPF partner.

The problem for a NRPF person if their partner is claiming UC, seems to the Housing Element of Universal Credit. Housing Benefit has been replaced by the Housing Element of Universal Credit but is calcultated diferently. Unlike Housing Benefit, a NRPF partner can accidently end up taking public funds though UC if the rental is in joint names.

The problem with somebody asking for the Public Fund, Council Tax Allownace/Redication/Benefit when they have a NRPF partner, still remains.

This article explains those two problems in detail.

Apart from Universal Credit being a new welfare system, during Covid, the UK operated a Trust and Protect for those asking for welfare benefits as they didn't have savings. The warning was given on their application, that they would be asked for documents/proof at a later stage and to make sure they were allowed to have those welfare payments. The DWP are now catching up on checking who took benefits that they were not allowed.
