My wife is on a J-1 visa. Her NIW (EB-2) petition is approved, with a priority date of March 2024. I am on J-2 status, along with our two children: my daughter (14) and my son (17, who will turn 18 on October 1). Our current J visas expire on September 6, 2025. We are all in the US now.
I plan to apply for an E-2 visa within the next month using premium processing. I believe my case is strong due to the following:
I have operated the same successful business for five years in Egypt.
I’ve already made sales and exports through my U.S. entity.
I’ve participated in trade shows and have booked a booth at WEFTEC this October.
I intend to show $150,000 in my account to support the application.
My goal is to obtain E-2 approval before my son starts college, then have my wife and children apply as E-2 dependents. This would ensure continuity of lawful status for all until our EB2 priority date becomes current. My son’s J-2 remains valid until September 2025, which offers a backup.
I need advice or confirmation on whether this is a wise and legal direction.
