Post by golu » Fri Apr 17, 2009 8:52 am

Hi All,

Can you please inform us when did your current leave to remain expired and when does ur new leave to remain start ?

I want to know if both of this periods co-incide

so for eg if ur visa expires on 25th may 2009, i want to know when does your new further leave to remain start and when does it expire ?

Trying to figure out if we will ahve issues when we apply for ILR in 2012

hey golu :D

i personally know peeps with following instances..

1) one of my friend applied for the extension 3 months b4 the visa expiry.. it was 2 months left for the visa expiry when his case was dealt with.. the caseworker approved the extn for 3 yrs starting from the date of visa expiry..
2) my bro's friend had few days shortage for the ILR thingi after they wud hav approved 3 yr extn.. he wrote abt it in the cover letter.. he had a good luck and the caseworker approved for 3 yrs and few days to meet the ILR condition (i dont remember how many days)..
3) another friend of my bro had similar situation.. he wrote abt it in the cover letter.. but he was given extn for only 3 yrs..
4) my bro recently applied for an extn.. his case was dealt with few days after his visa expired.. so they stamped such that the new visa expires 3 yrs later (from the last visa's expiry)..

So, its all basically luck.. if u you do not get lucky, worst case can be that u have to apply for one more extn only for few days or maybe few month (whichever applicable).. i bet u know abt this

all the best..

Please find my case below as there is a gap of almost 2 weeks in both the Visas but i am really not thinking about it as i filed my application 5 weeks before the expiry of my initial LTR.

Application Filed: 29th Nov 2008.
Initial Visa Expired: 08th Jan 2009.
T1 Extn Issued : 24th Jan 2009.

Since i have my reference letter which is enough to prove that i filed my extn 5 weeks prioer to leave expiry incase if any thing goes wrong.

But you have a point and ill try contacting UKBA to confirm this as i am due for ILR soon.

I have read similar story in this forum.
As per official guidance they are supposed to issue new LTR for a period of 3 Years.
I would say, if some one has got approval for more than 3 years, he/she must be very lucky to have gotten such longer leave.

I couldn't understand what exactly we are dicussing here. The UK visa doesn't have start date only expiry date. Don't get confused with Visa Issue date with start date.

If you apply for extension, before your visa expiry you current status is automatically extended till you get an visa extension.

Please read the FAQ link below
http://www.ukba.homeoffice.gov.uk/ukres ... ettlement/

What is my immigration status while my application is being decided?

if you make an application before your authorised stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. If your existing visa or other permission to stay here allows you to work, you can continue to do so until your case is decided.

If you let your visa expire and then apply for extension next day, your clock is reset.

Thats not true. The VISAs carry a valid from and valid until date. If one gets a VISA post-dated then he/she can not enter UK before the "Valid from" date.

I have got my approval (Extension from HSMP--> Tier-1 (General)) for a period of 3 Year and 1.5 months.
I think it is at the case worker's descretion to grant any additional leave beyond standard 3 Years.

Thanks for this amazing news, I intend to apply in July 2009 which is 4/5 months in advance as my Current leave to remain (HSMP) expires in jan 2010. But your friends extension is a record( 1 year in advance!!!).

You ve made my day I guess I am good to go.

Thanks

Hi nnj10,

My upcoming Tier 1 extension (from HSMP) if granted for 3 years would still leave me short of 30 days from reaching 5 year stay requirement.

I see from your post that you got a 1.5 months in addition to your 3 year extension. First of all, congratulatations..! I am also desperately hoping to get a 3 years + 30 days extension.

HMSP-ians covered under JR under some policy are given enough time on thier extend their visa until they cover the 5 year period. Were your covered under the JR?

If not, do you know if they give it for everyone who asks? Did you put in any special request in your covering letter?

ILR Short Issue

Post by rkrohela » Thu Apr 23, 2009 9:20 am

Hello,

I am in the same boat, initial stamping done on 01 Nov 2007, but I entered UK on 30 Nov 2007. This will leave me just 2 days short of ILR rule i.e 5 years less 28 days.

If I apply for early extn right now, and go through the PEO Channel, do you think they will grant extra period?

I do not have a Master's degree & it doesn't look like I can go for a part-time masters now based on my circumstances.

If I do not get my extension for 3 years + 1 month, I would have to go for a 2nd extension. I sincerely hope that I would not need a Masters then & would consider my Bachelors enough as my previous extension would have been with a Bachelors.

Do you guys think differently?

Anyone out there who got 3 years + extension through the PEO channel?
