Post by daudali » Fri Aug 21, 2009 11:39 am

hi All,

I am a Pakistani national and going to apply for ILR in Nov 15 2009 with my wife on the basis of Apprail HSMP Judicial review . My wife is pregnant now and we are expecting a baby on Nov 1 2009.

My questions are as fellow I will really really appreciate if someone can answers these

Question 1

Can my child (who will be only 10-15 days old) can apply ILR with us?

Question 2
Do we need to apply for Pakistani passport first before we include our child in ILR applications?

Question 3
Do I first need to apply for Leave to remain for my child before we apply for ILR?

I would appreciate if someone can answers me these questions.

Looking Forward to your replies

I apologize if this is not relevant to this forum.

One more question
Me and my wife planning to visit Croydon office to apply ILR and once we have that we will send MN1 form for our child.

But wouldnt caseworker at office will ask me about my child that why I didnt include my child as a dependent in ILR application?

Basically I wana avoid creating a child passport first and then add him/her as a dependent in my ILR application and then send his MN1 form.
and also I asked same question to home office and they have replied me

Please see below Home office response.

Dear Sir,

Thank you for your enquiry.

If your child will be born before you apply for ILR he should be included in your application and require his passport.

Yours faithfully,

Section 4a - Children born in the United Kingdom who are not British Citizens wrote:1. INTRODUCTION

This section relates to children born in the United Kingdom on or after 1 January 1983 who are not British citizens because, at the time of their birth, neither of their parents was a British citizen or settled here. Such children do not have the right of abode and are subject to immigration control. They are not here unlawfully, however, and are not required to apply for leave to remain (see ANNEX P, paragraph 11 if further guidance is required on this point)...
