Need some advice on FLR & ILR

Post by rigstud » Tue Apr 06, 2010 1:59 pm

Hi All,

I am after some advice and hoping someone could help me out.

My wife (british citizen) and I (Pakistani citizen) moved from Dubai to the UK nearly two yrs ago. She is my sponser and I had applied for the spouse visa in Dubai before entering the UK. I will soon have to renew my visa but not sure what form I need to use. I have looked at FLR and ILR but not sure which one I need to use. Or if someone could explain to me, what the difference is between the two. My wife and I have

Also I have not yet applied for the 'National Identity Card for Froeign Nationals. Do I need to apply for the I.D card first before applying to renew my visa?

Your advice with regards to this would be much appreciated.

If you have come on a 2yrs spouse visa and that the 2 yrs time is nearly up,and that you have spent all the two years in the Uk,then you will apply for Indefinite leave to remain (ILR).

However prior to applying for this , youwill need to pass teh English test (KOL).

Have you done this?

If yes then you will need to send this along with this form

http://www.ukba.homeoffice.gov.uk/settl ... et%28m%29/

http://www.ukba.homeoffice.gov.uk/sitec ... 420091.pdf

If on the other hand you have spent more than a considerable time of the 2 yrs outside the Uk, or you have not had the opportunity to take and pass teh English test, then you will need to apply for Further leave to Remain(FLR) first in order to do above.

Once you have done this, then you can apply for ILR.

Hope this answers your query

Hi Khan Saab,

Currently I still work outside the UK. A good estimate of time spent in the UK would probably be about 60% in the UK and 40% out of the UK.

I have not done the 'Life in the UK test" yet but will be doing it sometime soon as I understand I will need this for my application to extend my residency.

When I look at the ILR form it asks for the National Identity Card for Foregin nationals to be included with the application. When I look at the website to obtain one...it sounds like I can only apply for one with the ILR application.

So not sure what i need to do first. Could u please give me some clarification.

Thanks.

Also can someone confirm that I am understanding this right. After the ILR is issued and nearer to the time of expiry I can then apply for citizenship?? Is this right.?

Thanks.
