hi. Hope someone can help.
i have overstayed my visa. Had a student visa then tried to apply for a post study but was refused. I fell pregnant during the end of my studies. Was in a relationship with someone who was going through a seperation from his wive. he got his ILR though his marriage, now than they have decided to divorce. I wanted to find out what are my chances of marring then guy after his marriage ends and will the Home Office accept this. What are his chances of getting his citizenship after the divorce goes through.
ps i wasnt the reason for their separation met the guy when they had separated.
please help.

I believe the baby (when born) will be British because of the father's status. Make sure that the Birth Certificate aknowledges the father's status.

Once he is legally divorced, you may marry him. You have three options to legalise your stay.

1. Apply for Discretionary Leave - You need to use a good solicitor to help you wilth this application.

2. Leave the UK and apply for a Spouse Visa from your home country.

3. The recent Zambrano ruling can help you. Please note, you can only use this option once the child is born and is confirmed as a British Citizen.
