Starting a company/self-employment on Tier 2 (General)

Post by kwmr111 » Fri Jun 24, 2011 9:55 am

Hi All,

Can anyone provide me with an answer?

I am an Australia citizen who has just been sponsored by a UK company under the Tier 2 (General) visa. I am interested in starting a company/self-employment as a side hobby in online affiliates outside my normal hour work week in my sponsored job.

I came across this paragraph and wanted to know how I would go about gaining further permission from the Home Office?

"Tier 2 (General) workers are not allowed to enter self-employment, set-up a business or join another business as a director or partner without obtaining further permission from the Home Office."

Is there any more restrictions I should be aware of?

Appreciate your responses.

Thanks

This cant be right. In the guidance notes I was issued with my Tier-2 work permit, this was stated about supplementary work:

* It must be within the same profession and at the same professional level*
• The person remains working for the Sponsor from whom the Certificate of
Sponsorship was originally issued.
• The other employment does not exceed 20 hours per week.
• The supplementary work must be outside the applicant's normal working hours that the original certificate of sponsorship was issued for.

So how would you file for taxes if you work outside the normal hours and cannot be self-employed?

Hi rk_2011,

Supplementary work does not mean a business or self-employment. It actually means another job that relates to your profession.

So does that mean the other employer employing you for 20 hours max has to cut the tax and NI from source and pay you a salary? Meaning you cannot work as a contractor.
