My wife withdrew my Tier 1 application to get me deported

Post by bebu » Wed Oct 12, 2011 1:54 pm

hello guys,
funny story but true.

I have been coming to the Uk since i was 2 and even schooled here, but my parents always took us back to our home country.

However over 4 years ago, when i got married my wife who was a student here at that time said she wanted to do a phd and wanted me to support her, as I worked from home. So we moved to the UK and I paid all the bills, and she was pregnant and had a baby, but never worked till we parted a year plus ago

But after the marriage she went all difficult and manipulative, so we got stuck and applied to extend our stay here with the new TIER1 visa back then. She was the main applicant and I dependant since she was a student.

However without my knowledge she withdrew my application ( meaning I never had one, which would have made me illegal ) And she authorized the lawyers she used not to speak to me and lied to me that i was adivced to leave the country in 28 days, she also demanded £1,000 a month if i wanted to see our daughter who is going on 3 this month.

So i got in touch with a solicitor, who wrote the home office and who then assigned a reference ID to me and am now applying for discretional leave to remain under the human rights act.

I jsut thought i would share and get opinions before its submitted next week, on any advice on what I can do ?

meanwhile, she got her 3 year work permit and initially denied my access to my daughter, but now the case is at the mediation center and we are getting divorced

thanks

Wow, this is a pretty awful story. I don't know where to start.

On what basis are you applying for DLR?

You are dealing with the courts and seeking access rights, correct?

You can certainly apply, on the basis of best interest of the children to maintain a relationship with their father?

This seems quite a vindictive thing to do to one's husband.

I wish you all the best, let us know how it all went.
