Does anyone know the reveiew procedure and a time frame/
Can't bare to wait till March... as I am in UK and husband in Johannesburg.

hi we are in the same situation, visa refused last monday. i know usually the entry clearance manager in pretoria has to look over your evidence before sending to the appeals board in UK see link below for their guidanceJomags1 wrote:My husbands application was refused due to the English Language requiement. the fact that your spouse has passed the test now does not mean that the ECM is obliged to overturn the decision and nor does it mean that your appeal will succeed since you are required to meet the rules on the date of decision. As your spouse had not taken and passed the English language test on the date of decision, he didn't meet the rules. He would be better off reapplying for the visa.Jomags1 wrote:Hi

Time Line
13 September 2011 - VAF4 Form (initial application)
29 September 2011 - Notice of refusal received.
25 October 2011 - IAFT-2 form faxed included with this we sent the TOEIC Confirmation of Booking form and stated in the relevant section that the certificate was to follow.
31 October 2011 - Notice of pending Appeal - this letter was received 09 November at our home address with a date of 12 March for respondent to reply.
08 November - faxed certificate attained level 7 only need 1.
We have had no further communication and have no idea what to do next.
We are hoping to be together for Christmas is this a realistic hope.
Its great that there are people out there who take the time to help and advise as the UKBA don't offer a lot of info.

Please see replies from myself and Lucapooka above - your husband took his test after the decision and therefore the ECM is unlikely to overturn the decision - has you have to meet the rules on the date of decision. Similarly an appeal is also unlikely to succeed - you would therefore be better off reapplying.Jomags1 wrote:Hi peewee
What was the date on your IAT-2 form the letter saying they have received your appeal. This would give us an idea of whether or not to send in a new application.

hi, we didn't appeal formally, just asked pretoria to reconsider. we would have made a new application had they not changed their decision.Jomags1 wrote:Hi peewee
