HPDL Question and Advice

I am British and my wife is South African (we've been married since 2009).

In 2008 she had been classed as an over stayer as the home office had not replied to her application to stay in the UK since 2006 even though she had chased this up on numerous occasions.

So in 2008 we took the case to tribunal and we won and the judge granted discretionary leave to remain on humanitarian grounds.

She was granted LLR (Discretionary Leave) for 3 years which expired in October. We followed the guidance on the UKBA website and were advised to send a HPDL form.

We've just had a letter back saying that it is invalid and that she needs to pay £550 for some other visa (Don't have letter with me at work). So my questions are:

1. Was applying for HPDL the correct road to take?
2. Since this has been sent back to us does it make my wife illegal?
3. We don't have any money to pay the visas is there any help if they make us pay the £550?

Any help would be appreciated.

HPDL was the wrong form as this is only for people granted Discretionary Leave (or Humanitarian Protection or ELR) following the refusal of an asylum claim.

The correct form is FLR(O) and yes the fee is £550. UKBA may argue she has overstayed as didn't make valid app but as long as you make app on correct form asap they will prob make a fairly quick decision.
