Please help
Ok, I am applying for tier 1/general extension
Visa expires end of January
For me to make enough points to qualify for extension I have to show earnings over last 12 months.
the first month i came to UK my entire purse, wallet, passport and work visa were stolen
(1) was reported to police, and i have police report and crime reference number
(1A) I could NOT open a bank account in UK on copy of my work visa due to banking regulations. I could work in UK on copy of my work visa but not open an account...
(2) had to transfer TOC to biometric residence card, this process took roughly 3 months
(3) for 3 months my temporary employment wages were placed into my cousins bank account from the tempoary work vendor (weekly payment)
bc i could not open a bank ac in my name w. usa passport (took week to get) but only copy of UK work visa
(4) I have all my payslips, tax document and letter from employer/temp agency verifying they were placed into my cousins account
(5) bank statements from my cousin verifying all deposits. and a letter from him authorizing such deposits and acknowledging set up for 3 months in lieu of my passport stolen
(6) there is NO written guidance... and i know they 'tick the box' and can find almost any excuse to deny an extension.....
what should i do?
will they deny my extension bc 3 months of earnings are in another persons bank account and not mine?
what can i do??
the immigration advisor my employer hired said they dont know the answer. but they predict it will be an issue..
their only answer was taht they were going to send a 'query' to UKBA caseworker and would get an answer in 3-4 business days.....
Should i independently hire an immigration lawyer?
it is a simple legal question - will i be denied points for earnings when (1) my passport was stolen with work visa, (2)i could not open a bank ac in uk due to fsa regulation and (3) 3 months of earnings were deposited into another persons/my cousins account.
help help help
can this be any more stressful?
