Spouse VISA - few questions

Post by harv » Mon Jan 16, 2012 10:50 am

Hi Guys

I have been in contact with an agent (not a solicitor) to advise on the application and get me the following:

- House inspection report (by an independent authority)
- Certified Passport copy (certified by lawyers)
- Sponsorship letter (also certified by lawyers)

My time plan for the marriage and VISA application:

- Feb 5 Religious Marriage
- Feb 7 Court Marriage
- Feb 8 Visa application

During the meeting a few points were noted in the application and the the advise from the agent as well. Although I agree with him on some points I am not fully satisfied with them, so can I get your thoughts on this as well:

1 - Travel Dates (one of the first questions on the form)

The agent mentioned I can leave it blank. Is that correct? I was thinking of putting a date of one month from the date of submitting the application.

2 - 5.1 What are your current personal circumstances?

My partner is Unemployed and she has never worked, so I was thinking of marking the Unemployed column. The agent mentioned that I should tick Supported by other family member column and state that she is supported by her parents.

3 - 8.4.4 - When did your relationship begin?

Now for this I am a little puzzled. I have met my partner a couple of years back the first time but our marriage has been arranged. So the agent was saying that I should put the date of our Court Marriage in this question. I thought I should put in the date of my engagement as the start of the relationship, but then I do not have any formal evidence i.e. invitation cards etc as it was basically a small in house party etc.

4 - 8.4.12 - Have you lived with your sponsor in a relationship like a marriage or civil partnership at any time (including since a wedding or civil partnership ceremony)?

Although I have answered 'No' to this question, I am not sure whether that would be correct. Since I will be with my partner at the time of the application and we would have been living together as husband and wife since the marriage. So shall I say 'Yes' and mentioned that from the date of Religious Marriage we have been living together in India as I will be there for another couple of weeks with her.

One last thing boggling my mind a little is that we have moved in a Newly Build house for which we have not received any Council Tax bill as yet and no letter from the Council regarding the Council Tax either. Its a gated colony type area and only 2 houses in the whole area are being occupied, rest of the area is under construction. rubbish is being collected by the developers of the property and everything else as is being maintained by the developers. So no Council services are being used by the whole site.

I was wondering do I need some sort of letter to explain this from the property agent/Council or shall I leave this whole subject of Council Tax untouched? There is no mention of Council Tax on any of my documents that I have so far assembled.

Thanks in advance and sorry for such a long winded post.

Unfortunately i can't respond as i would like to know the answer to most of these myself!

With regards to your wife's current situation, if she is supported by family then put that.

Just answering a few of my own questions, please correct me if I am off the road:

1 - Travel Dates (one of the first questions on the form)

Not sure about this

2 - 5.1 What are your current personal circumstances?

Supported by Parents - I will add a signed doc from her father as well, confirm his support to my partner

3 - 8.4.4 - When did your relationship begin?

I think this is the date of the marriage, so I put that in.

4 - 8.4.12 - Have you lived with your sponsor in a relationship like a marriage or civil partnership at any time (including since a wedding or civil partnership ceremony)?

Yes, since marriage until the day I fly back to the UK

The Council Tax thing is still not clear, can someone please confirm if I need to show some sort of evidence of Council Tax as well???

1 - Date your spose wishes to travel (to the uk) put whatever you want about 1 month would be optimistic but there is no harm they will issue a decicion in thier own good time.

2 - yes doc from father, his bank statement too will help.

3 - Not date of marraige, its date you first started the relationship (first met), if it is an arranged marriage did you meet first and talk before marraige? put that date. should be before the wedding date unless you never met your wife before marraige.

4 - Give details of where you lived too, in whos home?

Council Tax you need to prove for the accomodation aspect. You can get a copy from the council. If you have never paid coucil tax then get some other utility bills like electric /gas.

4 - 8.4.12 It would ne YES since at the the time you hand in your app you will have lived together.

2 - 5.1 The applicant does not have to be working. Proving she is cabably of getting work and her savings would be beneficial. Yes put supported by parents if that is the case.

Will you visit your partner in thier own country to get married, which counrty if you dont mind me asking?

Also you dates are close together (marraige and hand in), you will need proof of your marraige ie photos ready within one day.

You case looks light on relationship contact proof. You didnt get engaged, or have any photos together? never wrote to each other? phone calls/txts?
Thank you immigrationboards.com

Hi Nadiii

Thanks for the reply, I was thinking the same as well:

1 - I will put down 1 month

3 - Yes I thought the same when I was speaking to my agent but he said the HO only looks at real evidence on papers like marriage certificate etc. I will enter my engagement date which was in September 2011.

4 - I do not have utility bills on my name but I have Sky and O2 bills. I will be adding the O2 bills in my application anyway to prove my communication. So I think this should cover.

I guess all questions are answered now :) thanks a lot.
