Advice about Qualifying Period

Post by Bells » Mon Mar 14, 2022 12:28 pm

I am a non EEA citizen spouse of an EEA citizen, moved to the UK in April 2016. My EEA wife started work in May 2016 while I was staying with our 6 months old child.

I applied for 5 years BRC in August 2016 & got the card in Feb 2017. My wife was working & studying till June 2018 & I had to care for our child.

I got employed in June 2018 & got settled status in July 2021. I am planning to apply for BC in July 2022, my main concern is I can only provide 4 P60's (2018/19, 2019/20, 2020/21 & 2021/22).  Can I use my council tax bill for 2017/18 as a proof to complete the 5 years qualifying period?

I read an article but not sure if I'm right that as long as the EEA sponsor/wife was exercising treaty right by been in employment during those period (2017/18), I should be covered by that. If that's true, will I have to provide her P60 for that period in my application?

Thanks all & anticipating for response.

Can someone advice me about this please? I am intending to apply for BC next month but I have worked only 4 years in the UK from 2018 to 2022, I came in 2016 but didn't work for 2 years as my wife was working & I was looking after our infant.
Can I apply using council tax bill covering 5 years & P60 covering 4 years?

You just need one document per year - where you don't have a P60 use Council Tax bill - one type of document is sufficient for a year.

Thanks for your response.
But I'm worried if not working in 2017 won't affect the 5 years qualifying period, I will be employed for 4years only when putting in my application.

Employment is not a requirement, you can be unemployed, retired, homemaker.

I'm relaxed now, I was worried about it for a while now. I really appreciate your swift response. I will update after I've put in the application with the timelines.

Also show that your absences were within the limits.

I have been outside the UK once only in 2017 for 10days, my only worry was the 4 years employment. I am anticipating for a straight forward process & fast decision.

There is no requirement to have been employed at all to apply for citizenship.
